David J. Noonan
Dave practices in the areas of Antitrust Liability, Professional Liability, Securities Litigation, Bank Litigation and General Business Litigation. Dave's current practice is devoted to the trial of commercial and business matters, for both plaintiffs and defendants.
Over the past three decades, Dave has represented clients as diverse as syndicates competing in the America's Cup yacht races, numerous professional athletes in a variety of litigation matters, Fortune 500 companies in defense of antitrust and product liability matters, and a former Playmate of the Year defending her right to use her title on the Internet.
He has amassed an impressive trial record representing corporations in major antitrust, securities, and banking liability matters. He served as co-trial counsel for Sempra Energy in the Continental Forge consumer class action (Natural Gas Antitrust Cases). This followed his work as lead counsel for ARCO in the successful defense of one of the largest consumer class actions in California history which sought damages for claimed antitrust violations in the retail sale of gasoline. As trial counsel for Ralphs Grocery Company he obtained a defense jury verdict in a consumer class action brought against Southern California's three major grocery retailers alleging price maintenance in the sale of eggs. He was co-lead counsel for a group of Fortune 500 companies in the successful prosecution of antitrust claims for the recovery of overcharges due to price fixing in the copper market. And, on behalf of Wells Fargo and a predecessor bank he achieved a string of favorable judgments and verdicts following trial in both state and federal court in representative actions brought by thousands of investors in the failed Pioneer Mortgage Company. Dave was also lead trial counsel for a team of attorneys who successfully represented California consumers in a class action lawsuit against a manufacturer of an ephedra dietary supplement for false and misleading print and television advertisements, obtaining a judgment for $12.5 million in restitution and injunctive relief. Recently, he successfully defended a group of lawyers against misconduct charges relating to document production in the much publicized Qualcomm sanctions proceedings.
He is a member of the American College of Trial Lawyers as well as the American Board of Trial Advocates (ABOTA). Dave was the 2005 recipient of the Daniel T. Broderick Award for trial excellence and professionalism as recognized by four major trial organizations in San Diego, where he has been an active leader in the bar including service as President of the San Diego County Bar Association, the San Diego County Bar Foundation, the San Diego Volunteer Lawyer Program and the San Diego Chapter of ABOTA. Listed in the Best Lawyers in America for Business Litigation for the past ten years, Dave is now listed under "Bet the Company Litigation." He has also been listed as one of the Top 10 Lawyers in San Diego by "Superlawyers" in both their 2007, 2008, 2009, and 2010 editions.
He has been a frequent lecturer on trial practice and is a Master with the American Inns of Court, Louis Welsh Chapter. Dave has also served as a Lawyer Delegate to the Ninth Circuit Judicial Conference.
In his spare time, Dave enjoys skiing, running, coaching youth sports, and keeping up with his four children, ages 15 to 28.
